BIDTEK Terms of Use

These Terms and Conditions ("Terms") govern your access to and use of the BIDTEK SaaS platform ("Service" or "Platform") provided by BIDDA HOLDINGS PTY LTD ("Company," "we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
1. Definitions
- "User" means any individual or entity using the BIDTEK Platform.
- "Subscriber" refers to a registered user who has purchased a subscription.
- "Content" means any data, text, documents, or materials uploaded, submitted, or accessed via the Platform.
- "SME" refers to Small and Medium Enterprises targeted by the BIDTEK service.
2. Eligibility
- Be at least 18 years old;
- Have the legal authority to enter into these Terms;
- Use the Service in accordance with these Terms and applicable laws.
3. User Accounts
- Maintaining the confidentiality of your account credentials;
- All activities that occur under your account;
- Promptly notifying us of any unauthorized access or use.
4. Subscription and Payment
- Access to BIDTEK is provided through tiered subscription plans.
- All fees are in AUD and exclusive of taxes unless stated.
- Monthly payments are auto-renewed unless cancelled by the user before the next billing cycle.
- Failure to pay may result in suspension or termination of access.
5. Use of the Platform
You agree not to:
- Use the Platform for unlawful purposes;
- Reverse engineer, decompile, or disassemble any part of the Platform;
- Share login credentials with unauthorized parties;
- Upload harmful or malicious content.
We reserve the right to suspend or terminate your account if you violate these Terms.
6. Data and Privacy
- BIDTEK collects and uses data as outlined in our Privacy Policy.
- You retain ownership of your content but grant BIDTEK a limited license to use it solely for service delivery.
- We implement reasonable security measures to protect your data, but we are not liable for any breach beyond our control.
7. Intellectual Property
- All intellectual property on the Platform (excluding user content) is owned by BIDDA HOLDINGS PTY LTD.
- You may not copy, modify, or distribute any part of the Platform without written permission.
8. Third-Party Links and Services
- The Platform may include links to third-party websites or services.
- BIDTEK is not responsible for the content or practices of any third-party sites.
9. Service Availability
- We strive to maintain 99.9% uptime, but availability may vary.
- We are not liable for interruptions caused by maintenance, technical issues, or force majeure events.
10. Termination
- You may terminate your subscription at any time via your account dashboard.
- We reserve the right to terminate or suspend your access for violations of these Terms or applicable law.
- Upon termination, your access to the Platform will cease, and data may be deleted after 30 days.
11. Disclaimers and Limitation of Liability
- The Platform is provided "as-is" and "as-available."
- We disclaim all warranties, express or implied, including fitness for a particular purpose.
- To the extent permitted by law, we shall not be liable for indirect or consequential damages.
12. Indemnification
You agree to indemnify and hold harmless BIDDA HOLDINGS PTY LTD, its officers, directors, employees, and affiliates from any claims, losses, damages, liabilities, and expenses arising out of your use of the Platform or violation of these Terms.
13. Changes to Terms
We may update these Terms from time to time. Continued use of the Platform after changes become effective constitutes acceptance.
14. Governing Law
These Terms are governed by the laws of the State of Queensland, Australia. Any disputes shall be resolved in the courts of Queensland.
